Adoption is a wonderful, life-changing decision. It marks the beginning of a new chapter full of promise and joy, but it also requires careful consideration and commitment.

Requirements for Adopting a Child FAQ

Here are eight questions we often hear from prospective adoptive parents:

1. What Are the Requirements to Adopt in Colorado?

Colorado only has two requirements for adoption regarding age and marriage. However, there may be additional regulations depending on the type of adoption you choose and the agency you work with. For more information about our requirements, you can contact us online.

2. What Are the Age Requirements for Adoption?

In Colorado, you must be at least 21 to adopt a child. This adoption age requirement ensures that adoptive families are mature and stable enough to care for children. While the state does not specify a maximum age for adoption, some agencies may not work with individuals over 50 due to age-related health and longevity concerns.

3. What Are the Adoption Marriage Requirements?

You do not need to be married to adopt a baby in Colorado. The only state requirement surrounding marriage is that spouses must file for adoption together. If only one spouse wants to adopt, they would not be able to provide a united, stable family environment.

4. Can LGBTQ Families Adopt a Child?

Yes, you can adopt a child if you’re gay. There are no U.S. state laws that ban LGBTQ adoption. Previous Supreme Court rulings and the Respect for Marriage Act protect your marriage and adoption rights as someone who’s LGBTQ. Unfortunately, some private adoption professionals may still discriminate on the basis of sexual orientation. If you’re pursuing private adoption, you’ll want to work with an agency like American Adoptions of Colorado that supports LGBTQ adoptive families.

5. Is a Home Study Required for Private Adoption?

Yes, you will need to complete a Colorado home study before you can move forward with the adoption process. This is one of the longest steps in the adoption process. You will need to submit personal documents, get a background check, schedule interviews, undergo a home inspection, contact personal references and more. We’re licensed to complete home studies in Colorado if you adopt through our agency. Otherwise, you will need to reach out to a home study provider.

6. Are There Any Financial Requirements for Adoption?

The state of Colorado does not have any financial requirements for adoption, but a social worker will evaluate your finances during the home study. You may need to provide copies of your paychecks, tax returns, bank statements and more.

7. What Are the Housing Requirements for Adoption?

Renting does not disqualify you from adopting in Colorado; there are no home requirements for adoption. You just need to show your home study social worker that you can afford your home and have enough space to raise a child. They will look at the space itself during the home inspection stage of the home study.

8. Are There Adoption Health Requirements?

There are no health or body mass index requirements for adoption in Colorado. However, a social worker will consider your physical and mental well-being during the home study. If your health concerns could impact your ability to parent a child, you might be denied.
